Jurent les Notaires, que Nos Souverains Seigneurs & Suppérieurs de la République de Berne reçoivent & admettent à tel art, de vouloir & devoir le plus soigneusement, et à la meillieure forme, qu’il leurs sera possible, noter, dresser, lever, et écrire touts et chaqu’uns, Contracts, Lettres, Instruments, Memoriaux, et autres Contracts quelconques, et de telle qualité, Nature et Condition qu’ils soyent, et les enregistrer en leur Prottocolles et Régistres, et de se conduire en l’exercise dudit Art, selon les Termes portés par l’ordonnance de Nos Dits Seigneurs, sur ce faitte et établie, et reformée, Aussy de signer de leurs Seings manuels accoutumés touts les Instruments, & Contracts que par Eux seront receus, & expédiés, pour quant aux Doutes et Difficultés que souvent surviennent, de la diversité du sense des Dits Lettres et Contracts, pouvoir avoir Rélation, au Notaire qui les aura receus, et à ses Protocolles & Régistres, lesquels ils seront tenus, d’apporter touts les quarts d’An, aux Seigneurs Bailifs sous la Prefecture desquels ils seront passés Notaires, avec une Déclaration et Spécification litterale de touts les Actes, qu’ils auront receus devants Lods & Sceaux, affin que l’exaction s’en fasse tant plus promptement, & que les Droits de Nos Seigneurs ne restent en Arrière, Et au Surplus de s’acquitter en tout, et partout, en l’exercise du Dit Art, Comme à bon, & féal Notaire appartient.
[Translation:
The Notaries Swear, that those who Our Sovereign Lords and Superiors of the Republic of Bern receive and admit to such art, shall wish and be obliged to prepare, edit, copy, and write each and every Contract, Letter, Instrument, Memorial, and any other Contracts whatsoever and of whatever quality, Nature, or Condition that they may be, as carefully as possible, and in the best form that they can, and to record them in their Protocols and Registers, and to conduct themselves in the exercise of said Art, according to the Terms contained in the ordonnance of Our Said Lords, on this subject decreed and established and as revised, Also to sign with their accumstomed manual seals all the Instruments and Contracts that they may receive and send out, and as for the Doubts and Difficulties that often come up, because of the diversity of meaning of the Said Letters and Contracts that they encounter, to refer to the Notary from whom they were received, and to his Protocols and Registers, which they shall have kept, to deposit them every quarter Year, to the Baillifs of the Prefecture in which they are accepted as Notaries, with a Declaration and literal Specification of all the Acts that they have received on which transfer taxes [Lods & Sceaux] are due, in order that the collection shall be more prompt, and that the Rights of Our Lords will not be in Arrears, And Further that they shall acquit themselves in every thing and in every way, in the exercise of Said Art, As a good and faithful Notary should do.
